Welcome to BirdyLingo ("we", "us", "our"). By creating an account or using our website and apps (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

1. Your account

You must be at least 13 years old to use BirdyLingo. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2. Subscriptions and billing

BirdyLingo offers a free tier and paid subscription plans. Paid subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel anytime from your profile. Fees already paid are non-refundable except where required by law.

3. Acceptable use

You agree not to: (a) scrape, reverse-engineer, or copy the Service or its audio library, (b) use the Service to harass anyone or upload unlawful content, (c) attempt to access another user's account or data, or (d) interfere with the normal operation of the Service.

4. Audio recordings

BirdyLingo's audio library includes recordings provided by naturalists under Creative Commons or similar licenses (including via Xeno-canto). Attribution and license details are shown on each recording. Those recordings remain the property of their original recordists.

5. Intellectual property

The BirdyLingo name, logo, lessons, software, and original content are owned by us. You may use the Service for your personal, non-commercial learning. Nothing in these Terms grants you any other rights.

6. Termination

We may suspend or terminate your account if you violate these Terms or use the Service in a way that risks harm to others or to the Service. You may delete your account at any time.

7. Disclaimer

BirdyLingo is provided "as is" without warranties of any kind. We don't guarantee uninterrupted or error-free operation. BirdyLingo is an educational tool — it is not a scientific identification service and should not be relied on for research or conservation decisions.

8. Limitation of liability

To the maximum extent permitted by law, BirdyLingo and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

9. Changes

We may update these Terms from time to time. If we make material changes we will notify you by email or in-app. Continued use of the Service after changes means you accept the updated Terms.
